As at 2026
These terms apply to all goods and services supplied by Forester IT Pty Ltd (“we”, “us”, “our”), including under the My C-Bus brand, to you (“you”, “the customer”). They apply unless we agree otherwise in writing.
What we supply
We supply:
- C-Bus design, programming, commissioning and on-site services;
- C-Bus and related equipment, including equipment we pre-program for you;
- remote support and monitoring; and
- online partner tools, such as project documentation and controller configuration, on a subscription or pay-per-use basis.
Quotes and orders
Quotes are valid for 30 days unless they state otherwise. A quote is based on the information you give us. If the site, the scope or your requirements turn out to be different, we may revise it. An order is accepted once you accept our quote in writing, pay any deposit, or we start the work, whichever comes first.
Prices and GST
Prices are in Australian dollars and include GST unless stated otherwise. Prices for online tools are shown in the tool before you are charged.
Payment
- Invoices: payment is due within 14 days of the invoice date, unless your invoice says otherwise.
- Deposits: for projects and equipment orders we may ask for a deposit of up to 50% before we order equipment or book work.
- How to pay: by bank transfer to the account shown on your invoice, quoting the invoice number.
- Card payments: where we offer card payment, it is processed by our payment provider. We don’t store your full card details.
- Bank details: we will never change our bank details by email. If you receive a message saying our details have changed, call us before paying.
- Account customers: approved organisations may be invoiced monthly in arrears for online tool usage. We decide who is approved and may withdraw account terms if payments are late.
Late payment
If an invoice is not paid by its due date:
- we may charge interest on the overdue amount at 10% per year, calculated daily from the due date until it is paid;
- you must pay the costs we reasonably incur in recovering the overdue amount, including debt collection agency fees and legal costs;
- we may suspend work, support or access to online tools until the account is paid; and
- any payment we receive is applied first to recovery costs, then to interest, then to the oldest outstanding invoice.
Online tools: subscriptions and usage
- Accounts and charges belong to the organisation, which may be a single person. The organisation is responsible for all usage by its users.
- Usage charges apply when you generate or download an output, not when you upload files.
- Any free updates or regenerations included with a purchase apply only to the same project. We may refuse or charge for an update that is in substance a different project.
- Subscriptions renew automatically each period until you cancel. Cancelling stops the next renewal. We don’t refund the current period except where the law requires.
- Deleted projects can be restored for 30 days, after which they may be permanently removed. Please keep your own copies of important files.
Delivery, title and risk
Delivery dates are estimates. Risk in equipment passes to you on delivery. Ownership of equipment stays with us until it has been paid for in full. Where the Personal Property Securities Act 2009 (Cth) applies, you agree we may register our interest.
Site work
For on-site work you must give us safe, timely access to the site and the information we reasonably need. Delays or return visits caused by the site not being ready may be charged at our standard rates. Changes to the agreed scope are variations and are charged in addition to the quote.
Cancellations and returns
If you cancel an accepted order, you must pay for work already done and for equipment already ordered that can’t be returned to the supplier. Returns of unused, undamaged stock are at our discretion and may attract a restocking fee of up to 15%. Pre-programmed or custom-configured equipment can’t be returned for change of mind.
Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Limitation of liability
To the extent the law allows, our liability for goods or services that are not ordinarily acquired for personal, domestic or household use is limited, at our option, to resupplying them or paying the cost of resupply. We are not liable for indirect or consequential loss, including loss of profit or data. Nothing in these terms excludes rights you have under the Australian Consumer Law that can’t be excluded.
Your data and intellectual property
Your project files and site data remain yours. You give us permission to use them to provide our services. Our software, tools, templates and documentation remain ours. Outputs we produce for you may be used for the site they were produced for.
Changes to these terms
We may update these terms from time to time. The version on this page when you accept a quote or place an order applies to that order.
Disputes and governing law
If there’s a problem, please contact us first and we’ll try to resolve it in good faith. These terms are governed by the laws of Western Australia, Australia.
